IPR OVERVIEW
One of the groups’ strategies is to have the products patent protected. As an example, Acticut International has an exclusive agreement with BTH (covering the dedicated projects where we have a significant part), for an exclusive first right of refusal for research results, which makes an important base for further product development. This also creates an excellent platform for resarch at BTH to be industrialized. Similar arrangements are implement for other company teams that BTH is working with, like Sony/Ericsson etc. Currently, the company team has a large patent portfolio that has been evaluated as "substantial" by two independent external expert evaluators. Since this evaluation was performed, we have won in patent court which has further increased the patent portfolio value. One of the patents has been awarded the prize as “Best Patent,” a key achievement.
Acticut International’s patent portfolio today consists of more than 25 patents and/or patent applications. The organization has a clear strategy to further develop and maintain these intellectual property rights and carefully weave them for maximum strength. Acticut® is a registered trademark.
The patent portfolio resides at the mother ship, Acticut International, and licenses are distributed to the daughter companies for maximum protection and tax code advantages.
CHALLENGED PATENTS
Our patent portfolio has been tested by the world leader in cutting tools for the metal cutting market. For them, it was essential to find the true strength of the Acticut International base patents and thus they challenged one of our patents. In response, we challenged strategic patents for them. Not only did we manage to defend our patent but also have the patent court judge in favor of our protest versus the large company's core patent. Thus, a settlement was proposed and an agreement with their IPR company was signed summer of 2007. Currently, based on new accomplishments, a series of new patent applications are submitted to further strengthen the IPR portfolio.
